Diversion Program

The Pinal County Attorney's Office Adult Diversion Program is an alternative to traditional criminal prosecution for defendants with minimal criminal histories. A primary goal of the program is to reduce recidivism by requiring participating defendants to complete treatment and education programs based upon their individual needs.

Defendants are selected based on numerous factors, including the current criminal charge, the defendant's overall criminal history, input and views of the crime victims, an evidence based risk assessment, and the likelihood that the individual defendant will benefit from the program and become a productive member of the community.

Violent and repetitive offenders or those who pose a significant risk to reoffend are not allowed to participate in the program. In this way, the Adult Diversion Program allows the resources of the Pinal County Attorney's Office to focus traditional criminal prosecution efforts on the most serious, dangerous felons, improve community outcomes and focus taxpayer funds where they are best utilized.

To participate in the Adult Diversion Program, an eligible defendant must admit guilt to the charged crimes, agree to pay full restitution to all victims, and be willing to do the hard work necessary to successfully complete the required treatment program. The program is participant-funded and requires each defendant to pay the costs of their own program.

Successful completion of the Adult Diversion Program results in a dismissal of the case and allows a defendant to avoid a criminal conviction. Defendants who fail to successfully complete the program will face traditional criminal prosecution.
