Writ Requirements:
Writ of Restitution
- Original Writ of Restitution and Two (2) conformed copies.
- One (1) conformed copy of Judgment.
- Judgment/Writ must contain property location/address and list all defendants/occupants.
- Cover Letter/Information sheet.
- Deposit of $200.00 must accompany paperwork.
Writ of General Execution
- Original Writ and Two (2) conformed copies.
- One (1) conformed copy of Judgment.
- Writ must contain judgment date, judgment amounts and list of all defendants.
- If vehicle(s) is to be seized, proof of ownership of vehicles is required (MVD Print).
- If real property is to be seized, a separate “Information Sheet” recorded with Judgment at the Pinal County Recorder’s office must be attached.
- See Writ of Special Execution Checklist if real property is to be seized.
- An Indemnity Bond for twice the amount of the Judgment and one copy (Please contact the Civil Unit with any questions).
- Cover Letter/Information Sheet
- Deposit of $200.00 must accompany paperwork.
Writ of Special Execution
- Original Writ and Two (2) conformed copies.
- One (1) conformed copy of Judgment.
- Writ must contain judgment date, judgment amount (if any) and must list the specific property that is to be executed against.
- Writ must command the Sheriff to either seize and sell or seize and turn possession over to plaintiff.
- Original Notice of Levy.
- Original Notice of Sale.
- Original Return of Sale.
- Original Certificate of Sale.
- Original Sheriff's Deed.
· A Litigation Guarantee Title Report confirming the ownerships of the property in question.
· Documentation stating the Homestead Exemption does not apply filed with the Superior Court in which the Judgment and Writ were granted.
- Deposit of $200.00 must accompany the paperwork.
Writ of Replevin
- Original Writ/Order and Two (2) conformed copies.
- Original Replevin Bond (made payable to defendant for two times the value of the property) OR a Cash Bond (two times the value of the property) in certified funds made payable to Pinal County Sheriff Office and One (1) copy.
- If the Writ/Order is "without notice", we will also require the Original Summons and Original Notices along with Two (2) copies of the Summons, Notices, Complaint, Application, Certificate, etc. The Writ/Order must also list the specific property we are to replevin as well as the property serial numbers, VIN(s), etc.
- Deposit of $200.00 must accompany paperwork
Writ of Garnishment
- Original Writ.
- Copy of Writ and everything to be served on Garnishee and/or Defendant.
- Deposit of $200.00 must accompany the paperwork.
Writ of Possession
- Original Writ and Two (2) conformed copies
- Copies or all other documents to be served
Writ of Habeas Corpus Ad Prosequendum
- Original Writ and Two (2) conformed
Writ of Attachment
- Original Writ and Two (2) conformed copies.
- Original Attachment Bond (Twice the value of the property) OR a Cash Bond (twice the value of property) in certified funds made payable to Pinal County Sheriff Office.
- Copies of Attachment Bond and One (1) copy.
- Original Indemnity Bond for the Sheriff's Office for the actual value of the property and One (1) copy.
- If against real property, the Writ must contain the legal description as well as the common address of the property to be attached.
- If against personal property, the Writ must describe the specific property or list a monetary amount to attach.
- Deposit of $200.00 must accompany paperwork.
